How it works

From living man to legal fiction

When a birth is registered, the government creates a legal fiction — a "person" — in the name of the child. This is not the living, breathing human being. It is a corporate entity, sometimes called the "strawman," that the State manages as a trust on your behalf — because, under the Cestui Que Vie framework, you are presumed lost at sea.

The birth certificate is the evidence of this registration. It is printed on bond paper (the clue is in the name), given a bond number, and can be tracked as a financial instrument on CUSIP bond databases.

Your name in ALL CAPITAL LETTERS on any legal or government document — your driver's license, your passport, your tax returns — is the legal fiction. The living man or woman is represented in mixed case. This distinction matters enormously in common law and maritime jurisdiction.
